Indiana Police Officer Pleads Guilty in Pedestrian Collision Case
A Fort Wayne police officer, Sgt. Joshua Hartup, has pleaded guilty to a serious traffic offense related to a tragic incident involving a pedestrian. The officer’s vehicle struck Henry Najdeski, a local attorney, while he was crossing the road on April 19. Tragically, Najdeski succumbed to his injuries three days later. This incident highlights the importance of pedestrian safety and the responsibility of drivers to yield to pedestrians in crosswalks.
Guilty Plea and Fines
Sgt. Hartup admitted to failing to yield to a pedestrian, resulting in bodily injury. As a consequence of his guilty plea, he was fined $35.50 by an Allen Superior Court magistrate. In addition to this fine, he had previously paid $139.50 in court costs. The court’s decision emphasizes the significance of adhering to traffic rules to prevent accidents and protect pedestrians.
Police Officer’s Response and Legal Outcome
In the aftermath of the collision, Sgt. Hartup issued a statement, explaining that he struck the pedestrian while completing a turn at an intersection. He promptly stopped his vehicle, provided aid to the injured pedestrian, and called for medical assistance. Despite this response, the incident had fatal consequences.
No Criminal Liability
Allen County Prosecutor Mike McAlexander recently announced that Sgt. Hartup would not face criminal charges for Mr. Najdeski’s death. While the legal outcome may not hold him criminally liable, the incident underscores the need for all drivers, including law enforcement personnel, to exercise caution and prioritize pedestrian safety.
Previous Disciplinary History
This unfortunate incident is not Sgt. Hartup’s first involvement in on-duty accidents. He has been disciplined for four prior crashes while on duty, although he has not faced any departmental discipline specifically for this crash. The incident serves as a reminder that road safety requires constant vigilance and adherence to traffic laws.
In light of this case, it’s crucial for drivers to be aware of pedestrians and yield the right of way to them. By doing so, we can work towards creating safer roadways for everyone.
